Trusted Counsel During Difficult Times
Guardianships and Conservatorships · Probate/Estate Litigation
Seeing a spouse, parent, child or other loved one become incapacitated by age, illness or injury is difficult. Everyday living becomes challenging, if not impossible, for him or her. You may be worried that he or she will be taken advantage of, subject to fraud or undue influence by others. In such a situation, you may wish to seek a guardianship or conservatorship in order to protect your loved one.
Likewise difficult are times when conflicts over a guardianship or conservatorship arise or when there are disputes during the administration of an estate.

Whether you are seeking to establish a guardianship or conservatorship or need dedicated and knowledgeable counsel during the probate or estate litigation process, the attorneys at Stutheit & Gartland, P.C., in Littleton, Colorado, are ready to help you. Contact us to schedule a initial consultation to discuss your probate matter.
Guardianships and Conservatorships
- In a guardianship, the court appoints someone to manage the day-to-day living issues of the protected person. The guardian makes decisions regarding matters such as health care and housing.
- In a conservatorship, the court appoints someone to manage the financial affairs of the protected person. Often, the conservator is the same person as the guardian.
From beginning to end of the process, we will handle everything for you in order to establish the guardianship or conservatorship. We will draft and file the petition for the Probate Court, prepare and present expert witnesses, and attend the appointment hearing with you. Once the guardianship or conservatorship is established, we will prepare and file the required reports on the status of the protected person.
Probate/Estate Litigation
We represent administrators, executors, trustees, heirs, beneficiaries and parties seeking appointment as guardians or conservators when probate disputes arise. When it comes to litigating your matter, attorneys Brian Stutheit and Patricia Watson have the skill, understanding and experience it takes to find a successful resolution to your case.
In our probate/estate litigation practice, we handle cases that arise in two main areas:
- Estate administration - contesting or defending wills, litigating claims of undue influence or fraud, presenting or defending claims against an estate, recovering stolen estate assets and representing the interests of omitted heirs.
- Guardianships and conservatorships - resisting inappropriate attempts to establish appointment, challenging misuse of authority, pursuing injury claims on behalf of the protected person and dealing with issues specific to farming, such as collecting unpaid rents, oil and gas royalties and proceeds from government subsidy programs.
